We've all seen advertisements while watching TV, listening to the radio, browsing the internet or walking down the street. Advertising is part of our everyday lives, so it is crucial to ensure that it is properly regulated and effectively monitored by the authorities.
Advertising is a sales promotion tool which may not only influence but also determine the transactional decisions of consumers. The consumer's right to be informed must prevail in all circumstances, so that advertising promoting the purchase of a product or the use of a service must not contain misleading statements.
The protection of the healthy physical, mental, spiritual and moral development of children and minors is a common social mission, as they are the foundation of the future of our society. In order to protect persons under the age of 18, it is essential to filter out advertising and advertisements that have a strong and harmful influence on children. The protection of children is also a priority in the context of advertising regulation, for which specific advertising rules have been laid down.
There are general advertising bans, which prohibit, for example:
- advertising that encourages violence or behaviour that endangers personal or public safety;
- advertising that encourages behaviour that is harmful to the environment or nature;
- advertising which may harm the physical, mental, emotional or moral development of children and minors;
- advertising of goods whose production or marketing is contrary to the law;
- advertising which is not recognisable.
NATCP in cooperation with its partner authorities, as the general advertising supervisory authority, carries out year after year a recurrent and intensive monitoring of compliance with the Advertising Act, with the aim of effectively protecting consumers' interests.
